How a Lawyer Supports Families After a Fatal Crash in Wayne County, MI

When a collision in Wayne County results in a fatality, the legal landscape in Michigan becomes exceptionally complex. A lawyer acts as an ally to navigate the intersection of probate law, No-Fault benefits, and wrongful death litigation. Here's what an experienced wrongful death lawyer in Wayne County can do for you and your family:

1. Navigate Michigan's Unique No-Fault Survivor's Loss Benefits

In Michigan, the No-Fault insurance system provides specific Survivor's Loss benefits to the dependents of a person killed in a motor vehicle accident. These benefits are designed to replace the financial support the deceased would have provided, including lost wages and fringe benefits, for up to three years.

A lawyer ensures that the insurance company calculates these benefits accurately and that the family receives the maximum daily rate allowed under current 2026 state guidelines.

2. Open an Estate and Manage Your Wrongful Death Claim

To seek justice for a fatal crash, a formal Wrongful Death action must be filed under MCL 600.2922. This process requires a lawyer to help the family open an estate in probate court and appoint a Personal Representative. This representative is the only individual legally authorized to pursue a claim for the family's loss of companionship, emotional distress, and the conscious pain and suffering the deceased may have experienced in the moments before their passing.

3. Preserve Evidence from the Scene

A lawyer will immediately move to preserve evidence such as the vehicle's Event Data Recorder (EDR), nearby business surveillance footage, and the vehicle's maintenance records. This is critical for determining if a mechanical defect, a road design flaw, or a third-party distraction contributed to the crash, which could open additional avenues for recovery.

4. Shield Your Family from Insurance Adjusters

Following a tragedy, families are often overwhelmed by paperwork and calls from insurance adjusters seeking recorded statements. These adjusters are trained to minimize the company's financial exposure. A lawyer acts as a buffer, handling all communications and ensuring that no statements are made that could inadvertently jeopardize the family's right to full compensation. This allows the family to focus on grieving and supporting the surviving injured members.

If you have been affected by a vehicle crash in Wayne County, you do not have to face the aftermath alone. A wrongful accident lawyer can help investigate liability and pursue compensation for medical expenses, lost wages, and other damages.
