Detroit, MI (October 31, 2026) – A child died, and five other people were injured in a three-vehicle crash on westbound M-8 (Davison Freeway) near I-75 in Detroit late Saturday night, October 31, according to Michigan State Police.
Preliminary findings indicate that a silver Chevrolet Impala rear-ended another vehicle, causing its driver to lose control and strike a third vehicle. Six people were inside the Impala when the crash occurred. A child was ejected and taken to a local hospital by Highland Park police officers, where the child was pronounced deceased.
The five other occupants of the Impala sustained injuries ranging from minor to critical. All six occupants were taken to local hospitals for treatment.
State Police reported that the Impala's driver was arrested on suspicion of operating while intoxicated and causing death and was receiving treatment for crash-related injuries.
Our hearts go out to the family and loved ones of the child who lost their life. We also wish those injured a full and speedy recovery.
What Legal Options May Be Available After a Fatal Drunk Driving Crash in Detroit, MI?
When a person dies in a crash involving a suspected impaired driver, eligible surviving family members may be able to pursue a wrongful death claim under Michigan law. Depending on the circumstances, compensation may include medical expenses incurred before death, funeral and burial costs, lost financial support, and other damages recognized by law.
A wrongful death claim is a civil action separate from any criminal case. The criminal investigation may examine whether the driver was impaired and whether criminal charges are warranted. A civil claim, meanwhile, focuses on whether negligence or wrongful conduct caused the death and what damages may be recoverable. An arrest does not by itself establish civil liability, so the evidence and circumstances must be reviewed independently.
Michigan's no-fault insurance system may provide certain benefits to people injured in motor vehicle crashes. Personal injury protection (PIP) benefits may help cover medical expenses and other eligible losses, depending on the injured person's insurance situation and applicable coverage.
The order of priority for seeking benefits can depend on the injured person's relationship to an insured vehicle and other statutory rules. For surviving family members, applicable insurance benefits and potential wrongful death claims may need to be evaluated separately.
Liability claims may also be available against a driver whose negligence caused or contributed to the collision. Depending on the evidence, claims may involve the driver's auto liability coverage and potentially other applicable policies. When multiple vehicles were involved, investigators may need to determine the sequence of impacts and whether any other driver contributed to the crash. Insurance coverage, policy limits, and each party's share of responsibility can affect the claims process.
Preserving evidence can help clarify what happened. The police report, vehicle inspections, photographs, witness accounts, and any available surveillance or electronic vehicle data may help establish the sequence of events. In a suspected impaired-driving case, toxicology results and other investigative records may also be relevant, subject to the applicable legal process.
Families and injured survivors should keep copies of medical records, hospital bills, funeral expenses, wage records, and insurance communications.
Michigan law sets requirements for who may bring a wrongful death claim and how any recovery is distributed among eligible beneficiaries. Deadlines also apply, and insurance policies may impose separate notice and filing requirements. Before accepting a settlement or signing a release, families and injured survivors may wish to review what losses are covered and whether future expenses have been considered.
